Ukrainian Nuclear Insurance Pool

The Ukrainian Nuclear Insurance Pool is an association of resident insurers that have obtained a license in accordance with the established procedure under insurance class 13, as defined in Article 4 of the Law of Ukraine “On Insurance”, to carry out activities related to the insurance of liability of nuclear plant operators for nuclear damage that may result from a nuclear incident.

The Pool is a non-profit organization funded exclusively at the expense of contributions from its members and does not engage in entrepreneurial activities. The Pool does not form an authorized capital.

Purpose of the Pool

The purpose of the Pool is to coordinate activities of its members related to the insurance of liability of nuclear plant operators for nuclear damage that may result from a nuclear incident and to ensure financial security of such insurance.

The Pool may also coordinate other types of insurance activities of its members in the nuclear energy sector.

Key objectives of the Pool

  • organization of insurance (co-insurance) of risks based on the principles of joint and several liability of Pool members;
  • organization of reinsurance to ensure that Pool members can fulfill their obligations under insurance (co-insurance) agreements in cases where risk coverage exceeds their financial capability;
  • coordination of activities of Pool members related to assuming reinsurance from non-resident nuclear insurance pools for liability of nuclear plant operators for nuclear damage that may result from a nuclear incident, as well as insurance/reinsurance of other risks (property damage and machinery breakdown, business interruption, Directors & Officers liability (D&O) of the carrier of nuclear materials, etc.) during the construction, operation and decommissioning of nuclear plants, provided that Pool members participating in such insurance/reinsurance hold relevant licenses under the insurance classes, as defined in the Law of Ukraine “On Insurance”;
  • implementation of unified standards, policies, regulations, rules, methodologies, procedures, model insurance and reinsurance contracts, and other documents aimed at protecting the rights of insurers who are Pool members, in order to prevent violations and abuses by insurers and/or ensure fulfillment of their obligations to the Pool and/or policyholders and/or reinsurers and/or reinsured entities;
  • participation in the development of draft legislative acts that contribute to achieving purpose of the Pool;
  • ensuring representation of the Pool and its members in Ukraine and abroad, in communication with the National Bank of Ukraine, government authorities, policyholders, insurers, reinsurers, reinsured entities, associations of insurers and public organizations, while also protecting interests of Pool members;
  • establishment and maintenance of the relations with foreign experts in the field of insurance of liability of nuclear plant operators for nuclear damage that may result from a nuclear incident, coordination of interactions with nuclear insurance pools in other countries;
  • analysis and generalization of insurance experience in the nuclear energy sector;
  • facilitating the nuclear safety expertise and assessing the nuclear damage;
  • conducting seminars and conferences on the issues related to insurance of liability of nuclear plant operators for nuclear damage that may result from a nuclear incident;
  • dissemination of information about activities of the Pool, conducting advertising campaigns in its interests;
  • establishment of branches, representative offices and other separate subdivisions both in Ukraine and abroad;
  • organization of scientific and methodological support for the Pool’s activities.

Managing bodies

General Meeting

– the superior managing body of the UNIP.

The competence of the General Meeting includes deciding on any issues related to the Pool’s activities.

All the members of the Pool shall have right to take part in the general meeting (Pool’s Statutes)

Board

— Board of the Pool (hereinafter referred to as “Board”) carries out management of Pool’s activities in the period between general meetings. (Pool’s Statutes)

The Board consists of the Pool members officials elected by the General Meeting.

Directorate

Directorate is executive body that manages day-to-day activities of the Pool.
